# Auto Power Search — Insertion Rules

The Insertion Rules ensure high marketplace quality, transparency, and trust for all buyers and sellers on Auto Power Search. By publishing an ad on our platform, you agree to comply with these rules as well as all applicable Swiss legal standards (including the Federal Act against Unfair Competition [UWG], the Price Disclosure Ordinance [PBV], and energy labeling regulations).

Auto Power Search reserves the right to edit, decline, or immediately remove listings that fail to meet these requirements.

## 1. Core Vehicle Requirements & Mandatory Conditions

To ensure every listing represents a real, traceable vehicle, the following conditions apply without exception:

- **Mandatory Unique VIN:** Every vehicle published on Auto Power Search must include a valid, unique Vehicle Identification Number (VIN). Vehicle listings missing a VIN or using a duplicate/dummy VIN will not be published.
- **Swiss CHE Number for Companies:** Commercial sellers and dealerships operating in Switzerland must provide a valid Swiss Business Identification Number (CHE number) during account verification or listing creation.
- **At Least 1 Vehicle Image:** Every listing must feature at least 1 original photograph of the actual vehicle. Text-only listings or listings relying solely on stock artwork are not permitted.
- **No Contact Information in Descriptions:** Phone numbers, email addresses, website links, social media handles, or physical address details are strictly forbidden in the main text description or vehicle title fields. All contact must take place via official Auto Power Search messaging tools or dedicated contact fields.

## 2. Listing Authenticity & Vehicle Availability

- **Single Listing Rule:** Each vehicle may only be listed once at any given time.
- **Physical Availability:** The seller must actually possess the vehicle. Vehicles that are merely ordered, pending order, or not yet physically present at the seller's premises cannot be listed.
- **Ready for Inspection & Delivery:** Vehicles must be available for viewing, test drives, and delivery within one week of publication.
- **Location:** The physical location of both the vehicle and the seller must be within Switzerland or the Principality of Liechtenstein.
- **No "Wanted" Ads:** Auto Power Search is a sales portal. "Wanted" or search requests are strictly prohibited in the vehicle marketplace.
- **Accuracy & Field Usage:** All specifications must be truthful. Structured fields (e.g., "Version" or "Trim") must only contain model, engine, or official edition specifications—not notes on discounts, leasing rates, or financing terms.
- **Direct & Parallel Imports:** Parallel or direct imported vehicles must be clearly declared as such in the listing details.
- **"Ab MFK" (Inspected):** The designation "Ab MFK" is permitted only if the vehicle’s last inspection was completed within the last 12 months or if a fresh inspection will be conducted prior to delivery at the seller’s expense.

## 3. Vehicle Images, Videos & Backgrounds

- **Actual Vehicle Photos:** Images must show the actual vehicle being offered. The vehicle must be fully visible and centered in the foreground.
- **No Image Editing / Alteration:** Photos must reflect the genuine condition of the vehicle. Modifying or airbrushing damages, scratches, or wear is forbidden.
- **Virtual Backgrounds:** Replacing the original background with a virtual wall is permitted only if:
  - The background is neutral and non-distracting (no bright, harsh colors or noisy patterns).
  - Brand logos or dealer names occupy no more than 1/8th of the background space and are positioned realistically behind the vehicle.
- **Privacy & Content Safety:**
  - License plates and recognizable faces must be blurred or obscured.
  - No phone numbers, email addresses, URLs, or physical address watermarks may be visible on the photos.
- **Copyright & Rights:** Sellers must hold full usage rights for all uploaded media (photos, videos, documentation).

## 4. Pricing, Fees & Mandatory Disclosures

- **All-Inclusive Final Price:** The price stated must represent the total mandatory end price owed by the purchaser. It must include Swiss VAT and all non-optional fees.
- **Delivery Fees (Ablieferungspauschale):** Any delivery or preparation fees must be integrated into the total listing price if they cannot be explicitly waived by the buyer.
- **No Installments in Main Price:** Listing monthly leasing rates or loan payments as the main listing price is strictly prohibited.
- **Electric Vehicle Batteries:** If the battery is included in the purchase, the total price must reflect the full cost with battery. If the battery is leased separately, this must be explicitly disclosed in the designated fields.
- **New Vehicle Disclosures (< 2,000 km):** For passenger vehicles or commercial vehicles with under 2,000 km, sellers must disclose official energy consumption, CO₂ emissions (g/km), and the applicable energy efficiency category.

## 5. Vehicle Classifications & Status

- **New Cars (Neuwagen):** Vehicles with a maximum mileage of 1,000 km and no older than 1 year from the manufacturing date.
- **Day Registrations (Tageszulassung):** Vehicles with max. 1,000 km and up to 1 year from the registration date that were registered for a short period and cancelled without being delivered to an end customer. The warranty start date and remaining duration must be transparently disclosed.
- **Demonstration Cars (Vorführwagen):** Registered vehicles with a maximum mileage of 15,000 km and registered for no longer than 1 year.
- **Accident-Free vs. Accident Vehicle:**
  - *Accident-Free:* Vehicles that have sustained no damage or only minor cosmetic/bagatelle damage (e.g., small scratches or paint chips that do not affect structural or safety-relevant components).
  - *Accident Vehicle:* Vehicles that have suffered structural, frame, safety system (e.g., airbag deployment), or major repairable damage must be declared as accident vehicles.

## 6. Prohibited Practices & Compliance

- **No Parts or Accessories:** Auto Power Search vehicle listings are reserved strictly for complete vehicles. Spare parts, tires, and standalone accessories are not permitted in the main vehicle market.
- **No Duplicate Refreshing:** Deleting an active listing and immediately re-posting it to reset publication dates or rank higher in search results is prohibited.
- **Right of Revision:** Auto Power Search reserves the right to update or modify these insertion rules at any time to maintain system integrity and user trust.
